These terms apply for all my services including the computer repair service, website design, the use of this website, becoming a member, remote support and anything else referred to below.
DISCLOSURE, TERMS and POLICY from Long Island PC Tech, LLC and LIPCtech.com and/or its owner Marcellino: A $50.00 fee is charged upfront, it will be deducted from the final charge. The pick-up and delivery of your computer is completely free, only labor charges by hour are applied, and only cash payments are accepted except for remote support in which case I accept Paypal as well. For credit card payments if needed as an emergency you will be charged an extra 3.7% after taxes. Taxes are to be collected unless the job is done for free and waived. If for an unexpected reason you decide not to hand the computer for repair, to call off the repair, the upfront fee above will pay for travel time/expenses, and it won't be refunded and it is a non-refundable fee. If for any reasons you interrupt the job or rush it, you will be charged for the time spent as you did not let the repair and/or job to be completed and warranty will not be applied. My computer repair rates are $35/Half-Hour and come with a money-back guarantee if any further repairs do not solve the issue. You have a 48 hours warranty on the repair, during that time you can verify the effectiveness of the repair, that your computer symptom/issue has disappeared completely and that it has been solved/fixed. If the symptom/issue should re-manifest itself within these 48 hours of warranty due to my service performance (up to now I am proud to say it has been unprecedented), you are guaranteed money-back if additional repairs do not solve the issue. In these instances below the additional repair will be billed and the money-back guarantee does not apply: If a new issue/symptom should manifest itself during the warranty that was not reported to me and/or is independent from my repair; If the same issue was repeated whether intentionally and/or accidentally. The hourly labor charges of $35/Half-Hour are non-refundable also if: 1. I diagnose the computer and no repair is made due to: I am unable to duplicate your issue; 2.The cost of labor and parts necessary to repair your computer will be of an amount close to the cost of a new computer or of an undesirable amount in which case you withdraw your decision to repair the computer; 3.You choose not to proceed with the repair after I initiated my repair service, you interrupt it or rush it and/or you choose not to proceed with re-installation of your operating system (worst case scenario), and/or you do not hand off the computer for pick-up and delivery to perform the necessary repair and/or any other necessary steps that will make your computer work once again and/or for any other reasons not mentioned here. You, the customer, guarantee and state you are the owner of the computer(s) to be repaired and/or website(s) to be designed and set up whichever applies to your case; if you are not the owner, you state, guarantee and promise under the laws of the United States that you are acting on their behalf with their granted permission and you take full responsibility for the payment and the repair and/or any other job performed by Marcellino, Long Island PC Tech, LLC, LIPCTECH.COM.
This legal agreement is between Long Island PC Tech, LLC, its owner Marcellino, its affiliates (collectively hereinafter referred to as "website", "site" or "we" or "Marcellino" or "LIPCTech.com") and you the customer. This Agreement includes LIPCTech.com policy, terms and disclosure in regard of any service performed by LIPCTech.com and Marcellino offered to you the customer, and governs your rights, obligations and restrictions regarding the service received.
You agree to indemnify and hold Long Island PC Tech LLC and Marcellino and LIPCTech.com and/or its subsidiaries and/or its affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of Long Island PC Tech LLC and Marcellino and LIPCTech.com and/or its subsidiaries and/or affiliates services, in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above.
You agree to indemnify and hold Long Island PC Tech LLC and Marcellino and LIPCTech.com and/or its subsidiaries and/or affiliates and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to the use of Long Island PC Tech LLC and Marcellino and LIPCTech.com and/or its subsidiaries and/or affiliates services. You agree to pay for all royalties, fees, and any other money owing any person by reason of violating these terms.
You agree to let Long Island PC Tech LLC and Marcellino and LIPCTech.com and/or its subsidiaries and/or affiliates and their respective officers, agents, partners and employees download, accept and sign agreements online and offline and/or from cd's, flash drives and/or any other media for the installation of various software and freeware for the purpose of diagnosis and/or repair and/or to accommodate your needs whether explicitly expressed or not by you the customer.
For example iTunes and/or Adobe reader will be updated and/or downloaded or any other specific software and/or freeware and online agreements and disclosures will be electronically signed and agreed on your behalf and will remain your responsibility in all senses and not ours and not the responsibility of Long Island PC Tech LLC and Marcellino and LIPCTech.com and/or its subsidiaries and/or affiliates and its respective officers, agents, partners and employees; our intent is to offer you the best possible service and set new standards for computer repair services!
The length of the repair can only be approximated but in no way can be guaranteed and estimated due to the normal diagnostic, troubleshooting and repair steps that need to be taken in order to finally repair the computer issue.
If you computer is under warranty when the problem is diagnosed, I Marcellino and Long Island PC Tech and LIPCTech.com and/or its employees will proceed with the repair anyway as I or we assume you did not want to take advantage of the warranty service offered by the manufacturer, it is your responsibility to check whether or not your computer is under warranty and if you can take advantage of it.
All these terms are governed and construed by the laws of United States, New York.
I, the customer, read, understand and accept the disclosure and the terms and policy above by LIPCtech.com and its owner Marcellino and Long Island PC Tech LLC, give permission to LIPCtech.com/Marcellino and Long Island PC Tech LLC to diagnose and repair my computer, I, the customer, acknowledge that I am responsible for all costs of parts and labor for services performed by Marcellino/LIPCTech.com. I (the customer) also acknowledge that if I leave my property (my computer and/or any parts that come with it including software) at LIPCtech.com Marcellino for longer than 45 days from the date printed on this form, after notiﬁcation by him of repair completion, after being notified by him (Marcellino/LIPCTech.com) by phone or email that he intends to return my computer and its parts to my residence and/or to an appointed destination of our choice, and fail to contact him back, said property may be sold to cover repair costs and/or said property might be donated or will be property of LIPCtech.com and its owner Marcellino.
Your information is kept private and will not be sold to third parties or disclosed to anyone.
Also, if you accept to make a video review of my services, you will get a discount of $20 from the final charge; this video will be used all over the Internet and for my business purposes, can be edited & marketed.
I, the customer accept, understand and acknowledge all the terms above.
